Amendment 3 · Legislatively referred constitutional amendment (HCS HJR 73, 2025)

Abortion, reproductive health care, and gender transition procedures for minors

Heads up: voting YES on this measure repeals the reproductive health care rights amendment Missouri voters approved in 2024.

Official ballot title (quoted exactly)

Shall the Missouri Constitution be amended to: Repeal the 2024 voter-approved Amendment providing reproductive healthcare rights, including abortion through fetal viability; Allow abortions for rape and incest (under twelve-weeks’ gestation), emergencies, and fetal anomalies; Allow legislation regulating abortion; Ensure parental consent for minors’ abortions; Prohibit gender transition procedures for minors?

Official ballot title as certified by the Missouri Secretary of State (2026 Ballot Measures page).

A YES vote means:

The reproductive health care rights section approved by voters in 2024 (Article I, Section 36) would be repealed, abortion could be restricted to medical emergencies, rape and incest under 12 weeks, and fetal anomalies, and gender transition procedures for minors would be prohibited, with exceptions for specific medical conditions.

A NO vote means:

Article I, Section 36 approved in 2024 stays in place, abortion remains available through fetal viability, and gender transition procedures for minors are not prohibited by this measure.

What it would change

  • Who is affected: people seeking abortions or reproductive health care, minors and their parents, and health care providers.
  • Other provisions (fair ballot language): allows laws regulating abortion providers and facilities, requires informed consent including parental or judicial consent for minors, and prohibits public funding of abortions except in limited circumstances.
  • Medical care: continues to ensure access to care for medical emergencies, ectopic pregnancies, and miscarriages.
  • Taxes: the fair ballot language says it will not increase or decrease taxes.
  • Fiscal impact (official fiscal note summary): State governmental entities estimate no costs or savings. Greene County estimates it may experience an unknown increase in tax revenue. Other local governmental entities estimate no costs or savings.
