Question 3 · Legislatively referred constitutional amendment
Discrimination and preferential treatment by government
Governmental entity discrimination prohibited. Shall section 27 of article I of the constitution be created to prohibit governmental entities in the state from discriminating against, or granting preferential treatment to, any individual or group on the basis of race, sex, color, ethnicity, or national origin in public employment, public education, public contracting, or public administration?
Ballot question as stated in the enrolled joint resolution and the Wisconsin Elections Commission Type A notice.
A YES vote means:
State and local governmental entities, including public schools, colleges, and courts, could not discriminate against or grant preferential treatment to anyone based on race, sex, color, ethnicity, or national origin in public employment, education, contracting, or administration.
A NO vote means:
No such section is added to the constitution; existing state and federal laws on discrimination continue to apply.
What it would change
- Who is affected: state agencies, local governments, public schools and colleges, job applicants, students, and contractors.
- Exceptions: actions needed to keep eligibility for federal funds, and bona fide sex-based qualifications reasonably necessary to normal operations.
- Federal law: the section would be applied to the maximum extent the U.S. Constitution and federal law allow.
- Fiscal impact: No official fiscal estimate is published for this constitutional amendment.
