Reproductive Freedom & Privacy Act. On every Idaho ballot. Official sources checked October 22, 2026.
Proposition One · Citizen initiative (statute)
Reproductive Freedom & Privacy Act
Heads up: voting YES on this measure would prevent the state from enforcing certain existing Idaho abortion laws.
SHORT BALLOT TITLE: Measure creating right to abortion before fetus viability, and post-viability to protect health; right to privacy; healthcare provider liability protections.
Short ballot title as printed in the 2026 Idaho Voter Pamphlet, Secretary of State. The long ballot title is printed in the pamphlet.
A YES vote means:
State law would create a right to abortion before fetal viability and afterward in medical emergencies, a right to privacy in reproductive decisions, and protections from penalties for patients and health care providers.
A NO vote means:
Idaho’s current abortion law stays in place, which prohibits abortion except to prevent the death of the pregnant woman and, in the first trimester, in cases of rape or incest reported to law enforcement.
What it would change
- Who is affected: pregnant people, health care providers, and the state.
- Other provisions (long ballot title): covers contraception, fertility treatment, and prenatal and postpartum care; restrictions before viability must be narrowly tailored to the patient’s health.
- Current law: the long ballot title says the measure would prevent the state from enforcing certain existing abortion laws.
- Fiscal impact: the Division of Financial Management estimates state costs of $3,100 to $7,800 per year, less than 0.001% of the state share of Idaho’s Medicaid budget.
Official arguments, summarized
Short neutral summaries of the arguments printed in the official voters’ pamphlet. The committees that wrote them are responsible for their content. Read the full text at the link below.
Argument for
Supporters say it restores health and life exceptions to the current ban, protects providers from prosecution, and protects contraception and fertility care; they say it does not create public funding or change parental consent laws.
Written by: Idahoans United for Women & Families
Argument against
Opponents say it changes the legal definition of viability to allow later abortions, lets non-physician providers perform abortions, and would override parental consent requirements.
