Virginia · Ballot measure
Question 2: Marriage
On the ballot: November 3, 2026 Legislatively referred constitutional amendment
Heads up: voting YES on this measure removes the same-sex marriage ban currently in the Virginia Constitution.
A YES vote means
The constitution’s ban on same-sex marriage would be replaced with a fundamental right to marry, and the state would have to recognize and treat equally any lawful marriage between two adults regardless of sex, gender, or race.
A NO vote means
The ban on same-sex marriage stays in the constitution; the ban is unenforceable under the 2015 Obergefell v. Hodges decision of the United States Supreme Court but would become enforceable if that decision were overturned.
