Public Question #1: Denying bail for offenses other than murder or treason
On the ballot: November 3, 2026 Legislatively referred constitutional amendment
Heads up: voting YES on this measure removes the constitutional guarantee that offenses other than murder or treason are bailable, when the stated conditions are met.
A YES vote means
A person charged with any offense could be denied bail if the proof is evident or the presumption strong and the state proves by clear and convincing evidence that “no release conditions will reasonably protect the safety of any other person or the community.”
A NO vote means
Only people charged with murder or treason could be denied bail on that basis; other offenses remain bailable.
