Amendment 81: Law enforcement communication with federal immigration authorities
On the ballot: November 3, 2026 Citizen-initiated constitutional amendment (needs 55% to pass)
A YES vote means
Law enforcement would have to try to determine whether a person charged with a violent crime, or charged with any crime after a prior felony conviction, is lawfully present, and notify federal immigration authorities within 72 hours if that cannot be determined.
A NO vote means
Current law stays as it is: cooperation with federal immigration authorities is allowed in some criminal matters, but state and local involvement in civil immigration enforcement is limited.
